Additional Terms of Use
(“Additional Terms”)

These Additional Terms of Use supplement the Terms and Conditions provided by our partner iubenda and form an integral part thereof. In the event of any conflict, the Terms and Conditions of iubenda shall prevail.

Use by Adults and Supervision

• The app is intended for adult users.
• Children under the age of 18 may only use the app with prior consent and under the supervision of their parents or legal guardians.
• Parents or legal guardians are the contractual partners and are responsible for their children’s use of the app.

No Real Personal Data of Children

To protect privacy and for data protection reasons, we ask you not to enter any real personal data of children (e.g. real full names or address data) when personalizing stories and characters.

Photos for avatars: Uploading photos for avatar creation is permitted and encouraged. However, we strongly recommend combining these avatars with imaginative, fictional names rather than real names. This allows you to make optimal use of personalization while protecting your child’s privacy.

All inputs should be creative and imaginative, without direct reference to real, identifiable persons. This helps ensure that use of the app remains safe and child-friendly.

AI-Generated Content and Disclaimer

How does the AI work?

• Stories, images, avatars, and audio content are created fully automatically by artificial intelligence
• The AI operates based on the information you provide (e.g. names, preferences, topics)
• There is no editorial or educational review of the generated content

What can go wrong?

Although we strive to enable child-appropriate content, AI systems are not perfect. The following situations may occur:

• Inappropriate content: The AI may occasionally generate content that is not age-appropriate, confusing, or unsuitable
• Factual errors: Stories may contain factually incorrect or misleading information
• Incomplete stories: Storylines may break off or not fit together logically
• Unexpected images: Illustrations may not meet expectations or include unintended elements
• Language errors: Texts may contain grammatical errors or unusual phrasing
• Cultural inaccuracies: The AI may misunderstand or inadequately represent cultural contexts

No Warranty

We provide no guarantee regarding:

• Accuracy, completeness, or timeliness of the content
• Educational or developmental suitability
• Compatibility with your personal values or parenting goals
• Technical error-free operation or uninterrupted availability

Your Responsibility as a Parent

You are fully responsible for:

• Reviewing all generated content (text, images, audio) before it is used by children
• Deciding which content is suitable for your child
• Adequately supervising your child’s use of the app
• Deleting or not using unsuitable content

Reporting Problematic Content

If you encounter inappropriate or problematic AI-generated content, you may report it to us at hello@kinderstories.app. This helps us continuously improve the quality of our services.

Rights to Uploaded Images

By uploading images (e.g. for avatars), you confirm that you hold all necessary rights and do not infringe any third-party rights. Parents or legal guardians additionally confirm that they are authorized to use images of their children.

Important: Uploaded photos are permitted for avatar creation and used for personalization. However, to protect privacy, we strongly recommend combining these avatars with imaginative, fictional names rather than real names. This keeps your child protected while allowing the app to create personalized content.

Virtual Currency “Story Coins”

The app uses a virtual currency called Story Coins, which can only be used within the app.

• Story Coins have no real monetary value.
• They are not transferable, tradable, or redeemable.
• Story Coins may only be used for in-app features (e.g. creating stories or avatars).

Monthly Story Coins with Premium Subscriptions

With an active premium subscription, Story Coins are credited monthly on the same calendar day on which the subscription was originally concluded. Unused Story Coins remain in the user account as long as the account exists.

Trial Period

• A free trial period is offered exclusively as part of an annual subscription.
• The trial period lasts 3 days.
• If the subscription is not canceled before the end of the trial period, it will automatically convert into a paid subscription.

Subscription Cancellation

• Subscriptions can be canceled at any time via the management of the respective App Store account.
• Cancellation becomes effective at the end of the current billing period.
• Already credited Story Coins do not expire and may continue to be used after the subscription ends as long as the user account exists.
• Further details on billing, renewal, and refunds are governed by the iubenda Terms and Conditions and the terms of the respective App Store.

For Users Downloading This App via the Apple App Store

• Warranty refunds: If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the extent permitted by law, Apple has no further warranty obligations.
• Third-party intellectual property claims: In the event of claims relating to infringement of third-party intellectual property rights, S3P Studios UG (not Apple) is solely responsible for investigation, defense, settlement, and discharge of such claims.
• Third-party terms: When using the app, you must comply with all applicable third-party terms, including your wireless data service agreement.

Reservation of changes

• We reserve the right to amend these additional terms of use if necessary for legal, technical, or content-related reasons.
